Copyright Law

We advise on the exploitation of your creative services and the enforcement and defence of claims in copyright disputes.

In the age of digitization and the almost unlimited availability of creative services, legally compliant exploitation, the enforcement and defence of copyright claims become more and more important. When dealing with creative projects, in particular with software development, it is essential to ensure that contracts are legally compliant at an early stage in order to secure rights from the very start.

In addition to a comprehensive understanding of the legal framework, we also offer many years of experience in the – in particular international – enforcement and defence of copyright claims and the drafting of corresponding contracts with employees, photographers, freelancers, agencies and other contractors from the creative industry.

On the other hand, the improper use of the creative work of others (e.g. an illegally copied image from the Google image search) often results in unreasonably high claims for damages and excessive injunctions. We advise on how to defend against such claims.

From license agreements for full use of the work results of your employees, to contracts for the promotional use of photos and software escrow-agreements we offer not only a high level of legal expertise but also the pleasure to find practicable solutions.

In the field of Copyright Law we offer the following consulting services:

  • Drafting customized license agreements for the use of commissioned work (e.g. with photographers, freelancers, agencies and other contractors from the creative industry)
  • Drafting of employment contracts for comprehensive transfer of rights to the work results of your employees
  • Legally compliant drafting of contracts and instructions for the fulfilment of information duties in event photography
  • Preparation and verification of legally compliant consents for the use of photos in advertising and external communication
  • Consulting and drafting of contracts in connection with the deposit of software (software escrow)
  • Enforcement of claims in case of illegal use of copyrighted content
  • Defence against unlawful or excessive claims resulting from the unlawful use of content subject to copyright.
