Modern working life does not only involve flexible working time models and changing places of work, but is often also characterized by questions of technology deployment: “Bring Your Own Device”, the use of social networks, whistle-blowing hotlines and the establishment of effective technical protection measures to prevent misuse and cyber-attacks have become part of everyday life for many companies.
However, to use flexible working routines and new technologies employers have to have collective agreements or individual consents of the employees in place. Moreover, questions about the lawfulness of processing personal data and data security also regularly arise. We advise in the legal assessment of works council agreements or declaration of consent of employees and assist in the negotiations with works councils in order to find solutions to both sides without burdening the working atmosphere.
Finally, we consult about the preparation of documentation in accordance with Privacy Law, like the establishment of records of processing activities, privacy policies and the conclusion of data processing agreements (DPA) with technical service providers (for more information, see “Privacy and ePrivacy”).
