New EU legislation on digital issues is difficult to navigate: Data Act (DA), Data Governance Act (DGA), Digital Markets Act (DMA), Digital Services Act (DSA), Artificial Intelligence Act (AI Act), European Health Data Space (EHDS), Cybersecurity Act, NIS-2 Directive (and Austrian Cybersecurity Act) and others implicate numerous opportunities for the reuse of data, but also numerous obligations to disclose data, for example in the area of the Internet of Things (IoT) or industrial or service data. In addition, there are obligations under the Austrian Freedom of Information Act for public institutions. At the same time, the use of data and new technologies such as artificial intelligence is regulated in great detail – with numerous transparency, compliance, and audit requirements that must be implemented in a practical manner, taking into account the GDPR, confidentiality, interoperability, and fair and non-discriminatory contractual terms.
